Official 2023 Contest Rules

THESE RULES ARE THE STANDARD TERMS AND CONDITIONS APPLICABLE TO THE DIVERSITY ATLANTIC AWARDS, PRESENTED BY TD AND ADVOCATE, AN ANNUAL AWARDS PROGRAM (REFERRED TO AS THE “CONTEST”) ADMINISTERED AND HOSTED BY TD AND ADVOCATE PRINTING AND PUBLISHING (THE “ADMINISTRATORS”). THE CONTEST IS INTENDED TO BE CONDUCTED IN NOVA SCOTIA, NEW BRUNSWICK, NEWFOUNDLAND AND LABRADOR AND PRINCE EDWARD ISLAND (REFERRED TO AS “ATLANTIC CANADA”) CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW UNLESS OTHERWISE STATED. NO PURCHASE IS NECESSARY. NO ENTRY FEE IS NECESSARY. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THE CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE “CONTEST RULES”).

1. Eligibility

The Contest is only open to legal residents of Atlantic Canada who are 18 years of age and older on the date they entered the Contest. Eligible entrants must own or manage a business operated in Atlantic Canada and products of said business must be physically made in and be available for sale in Atlantic Canada. Eligible entries may fall into the following industry categories: Consumptive Retail Products (food/drink producers, processors and growers, or related industry), Non-Consumptive Retail Products and Services (fashion, personal style, craft, home and garden décor, construction materials, and travel industry offerings, and Information and Technology (residential and commercial friendly technology, security systems, educational software for at-home tutoring or in-class use, etc.). Each industry category includes three business categories: micro business (five or fewer employees), small business (five to 25 employees) and medium business (25-50 employees). Eligible businesses and individuals may be new or established. They must be led by a diverse team or have intentionally diversified their team, demonstrating that diversity is a core value, and have proven innovation, leading edge thinking and unique approaches to complex diversity and inclusion issues faced in the workplace. Where its category requires, eligible businesses and individuals must have the ability to have products that can be reproduced for sale or be part of a similar line of items available for sale. Employees, directors, and officers of the Administrators, and its parent companies, affiliates, franchisees, subsidiaries, distributors, representatives, advertising and promotional agencies, agents, sponsors, and any entity that they contract with specific to the Contest, as well as the immediate family members, and any persons domiciled with any of the above (whether related or not), are not eligible to win an Award and affiliated Prize.  Entrants must review full Contest Rules before submitting their entry.

2. How to Enter

NO PURCHASE OR ENTRY FEE NECESSARY. You may enter the Contest by using the online entry form to guide you through the submission process: https://diversityatlanticawards.ca/awards/submission/.  When entering a category, please explain the company’s initiatives, processes and leadership plan regarding diversity, equity and inclusion in an essay of at least 500 words and up to 1200 words.

Limit of one entry during the Contest Period. All Entries are referred to as the “Eligible Entries”.

3. Timing

The Contest runs from March 1, 2023, beginning at 12:00 a.m. ADT through June 30, 2023, at 11:59 p.m. ADT. Access to the contest will open and close as stated on official accounts and communication of the Administrators. Upon closing, any attempt to enter the contest outside of the times specified will be prohibited. Entries must be received by June 30, 2023, 11:59 p.m. to be eligible.

4. Prize Description

There will be three (3) prizes awarded per category for a total of nine (9) prizes.

Prizes have no equivalent cash value, are non-transferable and no substitutions will be made. Prizes must be accepted as awarded. The Administrators reserve the right to substitute any Prize for one of equal or greater value for any reason. Participants are responsible for all costs not expressly described as being included as part of the Prize, such as taxes and any fee associated with the receipt and/or use of the Prize. If the Prize cannot be mailed, winners are responsible for picking up their prizes at the disclosed locations. All terms and conditions apply to the Prize.

5. Judging Details

The Judging Period will follow the close of the Contest Period, running July 15, 2023, until September 15, 2023. A panel of five (5) qualified judges will choose one winner from three company sizes in each of the three categories for a total of nine (9) winners.

The Administrators reserve the right to disqualify participants at their sole discretion. The Administrators takes no responsibility for lost entries. Automated entries of any kind are not allowed. Detection of said automated entries will lead to submission being voided. Winner selection as decided by judges are final and binding.

6. Winner Selection

Those chosen to be eligible to win a Prize will be contacted within one week of judging completion via telephone. Official results will be announced on October 15th, 2023.

Before being declared a winner, select participants may be required to send a sample of their product at the judges’ discretion. Upon such circumstances, the participant will be notified in advance on or before August 15, 2023. Please only send your product if you receive an email request.

If the selected entrant does not respond within the prescribed timeline set out in the notification, they will be disqualified and will not receive a prize and another entrant may be selected (as determined by the Administrators in its sole discretion) until such time as an entrant satisfies the terms set out herein. Selection for sampling does not indicate a prize will be awarded. The Administrators is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for the Administrators to receive a selected entrant’s response.

Before being awarded a prize, each winning company may be required to sign NDA, liability and publicity release forms that must be returned within seven (7) business days of the date on the prize notification. Otherwise, the prize will be forfeited, and an alternate winner will be selected.

7. Confirmation of Identity

In the event of a dispute about the identity of an entrant, each entry will be declared made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is defined as the natural person who is assigned to an email address by an Internet Service Provider, online access provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. With respect to each winning entry, the winner may be required to provide proof that the winner is the authorized account holder of the email address associated with the winning entry. Entrants agree to be bound by Official Rules and agree that if a winner fails to provide proof of identity, refuses to provide required affidavit, is found to have violated Official Rules, or otherwise does not meet eligibility criteria, the prize will be forfeited and awarded to an alternate winner at the judges’ sole discretion.

8. Forfeit of Prize

If winners cannot be reached within seven (7) days of the Administrators’ first attempt to contact or otherwise fail to comply with these Contest Rules, then the Prize will be forfeited, and another entry will be randomly selected from among the remaining eligible entries as per these Contest Rules. This process of selecting a Prize winner will be repeated until all Prizes eligible to be won have been awarded.

9. Use of Personal Information

By entering the Contest and voluntarily providing personal information as described in these Contest Rules, you agree to the collection, use and disclosure by the Administrators and its respective employees and/or authorized agents, of your personal information, for the purpose of administering the Contest, including—but not limited to—contacting you with respect to the Contest if you are a selected entrant or opt-into being contacted for further information. Personally identifiable information will only be used to administer the Contest and for no other purpose, except as specifically outlined in these Contest Rules. Personally identifiable information will not be sold, shared or disclosed by the Administrators to any third party, other than a third party engaged by the Administrators for the purpose of administering the Contest or delivering a Prize, or if required by law with the exception that aggregated information may be used by or shared amongst the Administrators and its subsidiaries and affiliates, or shared by the Administrators with third parties in accordance with our Privacy Policy available at https://advocateprinting.com/aboutus/privacy-policy.

 

10. Publicity Consent

By entering the Awards, you agree that if you are determined to be a winner, the Administrators may use your name, comments, voice, likeness, municipality of residence and picture in any advertising, promotion or publicity carried out now or in the future, in any media without compensation or notice, and you grant to the Administrators any and all rights to such use. You agree to cooperate with the Administrators in arranging for photographs or other forms of publicity and to be available for photographs or other forms of publicity on reasonable notice.

 

11. Limitation of Liability/Release

By participating in the Contest, and as a condition of acceptance of the Prize, you, your heirs, executors, Administrators, successors and assigns, release and forever discharge and hold harmless the Administrators, and their direct and indirect parent companies, affiliates, subsidiaries, successors, assigns, agents, advisors, franchisees, shareholders, partners, representatives, their advertising, promotion and fulfillment agencies and each of their respective employees, officers, directors, agents and representatives (collectively, the “Released Parties”), from and against any and all losses, damages (including, without limitation, direct, indirect, incidental, consequential or punitive damages), rights, claims, actions, causes of action, personal injury, exposure to the COVID-19 virus, property damage or death, including without limitation all costs and liabilities of any kind including legal fees on a substantial indemnity scale, hereinafter called “Claims” and including without limitation any claims arising from any act of negligence of the Released Parties, that you now have, or may hereafter have against the Released Parties directly or indirectly resulting or arising from: (i) participation in the Contest, or the awarding, acceptance, possession, use, or misuse or enjoyment of any Prize, and where applicable, traveling to, preparing for, or participating in, any Contest-related or Prize-related event or activity, or (ii) the publicity rights granted to the Administrators. You specifically acknowledge that you understand that there may be serious risks of bodily injury, death, or property damage associated with the acceptance, possession, use and/or misuse of the Prize and attendance at any event or participation in certain Prize-related activities, and you voluntarily assume these risks. You also agree to indemnify, defend, and hold harmless the Released Parties from any and all Claims in respect of the foregoing.

12. Compliance with Rules

By entering the Contest, you agree to abide by the entire Contest Rules and the terms and conditions under which the prizes are awarded. Any decision made by the Administrators in respect of the Contest shall be final.

13. Technical Issues

The Administrators is not responsible for any computer, online, telephone, hardware, software or technical limitations or malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry, or failure to receive an entry), nor for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest, nor for any error, omission, interruption, deletion, defect, delay in operation or transmission or receipt of entry, communications line failure, theft or destruction or unauthorized access to, or alteration of entries; and, are not responsible for any problems, failures or technical malfunction of any telephone or network lines, computer online systems, servers, providers, computer equipment, software, email, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website or on account of any combination of the foregoing; and are not responsible for any injury or damage to entrants or to any computer related injury or damage resulting from participating in downloading materials in the Contest. In the event that, due to a printing, manufacturing, mechanical or other error of any kind or nature whatsoever, more Prizes are claimed than are intended to be awarded according to these Contest Rules, Prizes will stop being awarded when the Administrators becomes aware of an error respecting the number of Prizes. The Administrators reserves the right, in their sole and absolute discretion, to conduct a random draw from amongst all eligible and approved Prize claimants whose claims have not yet been redeemed to award the remaining number of advertised Prizes. In no event will the Administrators be liable for more than the stated number of Prizes contained in these Contest Rules.

14. Rights to Terminate/Modify/Suspend Contest

The Administrators retain the right, in their absolute discretion, to suspend, modify or terminate any aspect of the Contest (including, but not limited to these Contest Rules) at any time. The Administrators may make substitutions of equivalent kind or value in the event of the unavailability of a prize (or component thereof) for any reason whatsoever. They may terminate or withdraw the Contest at any time by posting a notice via website, social media or email communication. If the Contest is terminated on any day prior to the normal Contest end date (the “Termination Date”), the Administrators may determine the winners from all eligible entries received as of the Termination Date (which winners shall be randomly selected in accordance with these Contest Rules).

15. General Disqualification

Any attempt made by an entrant or other individual or entity, to deliberately damage, manipulate or undermine the legitimate operation of the Contest, including but not limited to any fraudulent claims, is a violation of the law. The Administrators reserves the right to seek remedies and damages from any such individual or entity which makes any such attempt. Any entrant who, in the opinion of the Administrators, is determined to be engaging in any of the foregoing activities will be immediately disqualified from the Contest.

16. Mobile Devices

You have the option, but are NOT required to, enter the Contest by following the instructions provided above using a compatible mobile device. Standard data use and service rates apply and may vary according to your mobile device package and mobile service provider. Please contact your mobile service provider for details before participating in the Contest using a compatible mobile device.

17. Jurisdiction

These are the official Contest Rules. The Contest is subject to applicable federal, provincial and municipal laws and regulations. The Contest Rules are subject to change without notice to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Administrators and/or the Contest. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and the Administrators in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Nova Scotia including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

18. Language Discrepancy

In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry forms, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.

19. Social Media

The Contest is in no way sponsored, endorsed or administered by any social media platforms on which the Contest may have been promoted and/or publicized. Any questions, comments or complaints regarding the Contest must be directed to the Administrators.

 

The Administrators reserve the right to change the rules at any time. This contest is officially presented in partnership by TD and Advocate.
